Residential SUD providers must enroll as 1115 demonstration project providers

Substance Use Disorder (SUD) residential treatment programs must enroll as 1115 demonstration project providers obtaining 245G licensure by Jan. 1, 2024, or claims will be ineligible for payment.

  • If residential SUD providers do not attest to having ASAM criteria in place prior to January 1, 2024, their claims are not payable. They will need to complete the 1115 Demonstration. 
     

Background

The Minnesota Department of Human Services (DHS) has provided the guidance below for providers requiring Jan. 1, 2024 and Jan. 1, 2025 enrollment in the 1115 Demonstration. Per DHS, the Centers for Medicare and Medicaid Services (CMS) uses 1115 SUD Demonstrations to expand access to high quality, clinically appropriate SUD treatment using American Society for Addiction Medicine (ASAM) levels of care.

Providers requiring an enrollment date prior to Jan. 1, 2024

The following SUD providers are required to enroll in the 1115 Demonstration by Jan. 1, 2024:

  • Minnesota residential treatment providers licensed by the Minnesota Department of Human Services (DHS) and enrolled in Minnesota Health Care Programs (MHCP).
  • Minnesota withdrawal management providers licensed by DHS and enrolled in MHCP.
  • Out-of-state residential SUD providers enrolled in MHCP.

Providers requiring an enrollment date prior to Jan. 1, 2025

The following SUD providers are required to enroll in the demonstration by Jan. 1, 2025:

  • Minnesota nonresidential treatment providers licensed by DHS and enrolled in MHCP.
  • Hospital-based residential treatment providers licensed by DHS and enrolled in MHCP.

Tribally licensed providers may elect to participate in the demonstration.
 
These enrollment requirements are according to Minnesota Statute 256B.0759, subdivision 2. Providers may email 1115demonstration.dhs@state.mn.us with questions or to request assistance in completing the enrollment application. 

Hennepin Health action

Hennepin Health monitors updates to the DHS PECD website to update internal programming for new SUD providers and provider locations who have completed provider certification under the federal demonstration waiver.  Hennepin Health regularly secures reports based on the effective dates and adjusts claims for those who qualify for 1115 waiver demonstration rates.
